Welcome to June Bug Labs! These Terms of Service ("Terms") govern your use of our website junebuglabs.com and our software-as-a-service platform Invisio (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By registering for an account or accessing the Service, you confirm that you are of legal age to form a binding contract (or, if you are a minor, that you have parental consent) and that you have the authority to bind any organization you represent to these Terms.

2. Description of Service

June Bug Labs provides an Inspection compliance platform which facilitates the performance of Stormwater (SWPPP) and Spill Prevention (SPCC) inspections to ensure users are compliant with the terms of their related permits and plans as they relate to the EPA guidelines. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your internal business or personal purposes, subject to these Terms.

3. User Accounts

Registration: To access certain features, you must register for an account. You agree to provide accurate and complete information.
Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
Notification: You must notify us immediately of any unauthorized use of your account.

4. Payment and Subscriptions

Fees: Access to certain features requires a subscription or license. You agree to pay all fees associated with your chosen plan.
Billing: Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually). You authorize us to charge your payment method for these fees.
Refunds: Except as required by law, all fees are non-refundable.

5. Acceptable Use Policy

You agree not to use the Service to:

Violate any applicable laws or regulations.
Infringe the intellectual property or privacy rights of others.
Upload malicious code, viruses, or malware.
Engage in any activity that interferes with or disrupts the Service.
Attempt to reverse engineer, decompile, or copy the Service’s source code.

6. Intellectual Property

Our IP: The Service, including its code, design, logos, and features, is the exclusive property of June Bug Labs and its licensors.
Your Content: You retain ownership of any data, files, or content you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, royalty-free license to use, store, and display your content solely as necessary to provide the Service to you.

7. Trademarks

The trademarks, service marks, and logos, including but not limited to June Bug Lab's name, logo, and all related names, logos, service names, designs, and slogans (the “Trademarks”) used and displayed on the Service are registered and unregistered Trademarks of June Bug Labs or others. Nothing on the Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Service, without the written permission of the Trademark owner. June Bug Lab's Trademarks may not be used in any way without prior, written permission of June Bug Labs. We prohibit the use of June Bug Lab's name or Trademarks as a “hot” link to any website unless we first approve the establishment of such a link in writing.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

9. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, June Bug Labs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be error-free or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, June Bug Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless June Bug Labs, its officers, directors, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Idaho USA, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in McCall, Idaho USA.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the Service or sending you an email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Notice Regarding Apple

This section only applies to the extent you are using our mobile application on an iOS device. You acknowledge that these Terms are between you and June Bug Labs only, not with Apple Inc. ("Apple"), and Apple is not responsible for the Service or the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund any applicable purchase price for the mobile application to you; and, to the maximum extent permitted by applicable law,

Apple has no other warranty obligation whatsoever with respect to the Service.

Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including, but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Service or your possession and use of the Service infringes that third party’s intellectual property rights. You agree to comply with any applicable third-party terms when using the Service. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this section of these Terms against you as a third-party beneficiary.

You hereby represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. If June Bug Labs provides a translation of the English language version of these Terms, the translation is provided solely for convenience, and the English version will prevail.
